01 / Abstract
Context and purpose.
Medicines can affect alertness, reaction time, vision and metabolic control even when taken as prescribed. This article distinguishes immediate driving safety, medical fitness for a driving licence and medico-legal assessment of driving under the influence of psychoactive substances.
It reviews the Romanian and European legal frameworks, toxicological analyses and specialist medico-legal assessment, with illustrative tables of relevant medicines. A comparative section explains the Nordic red triangle, the three French warning levels and the DRUID scale, separately from the black pharmacovigilance triangle.
02 / Key findings
Conclusions to retain.
- 01A prescription does not guarantee safe driving or provide a general exemption from criminal liability.
- 02Substance detection and its capacity to impair driving require individual assessment under High Court Decision No 25/2025.
- 03Specialist medico-legal assessment integrates toxicological, clinical and circumstantial evidence.
- 04Nordic warnings use a red triangle; France has three levels, while the DRUID model has four colour-coded categories.
- 05The tables are illustrative: always check the exact product leaflet and SmPC section 4.7.
