Why Road Police records matter.

They may confirm the existence, date and location of the accident, vehicles and people involved, recorded circumstances and measures taken. They contribute to review of liability and RCA cover, but do not prove every head of loss or replace evidence of property or bodily injury.

There is no universal list.

Requirements vary with the type of accident, recording method, injuries, stage of investigation and justified insurer requests.

    Property damage only

    Depending on the circumstances, the accident may be recorded by the Road Police or by an amicable accident statement where statutory conditions are met. That statement is not a police document.

    Injury or death

    The police must be informed immediately and duties concerning the accident scene must be observed. An amicable statement does not replace this procedure.

Where persons are injured, criminal investigation, medico-legal work and prosecution or court documents may result, and the compensation file may need successive additions.

Documents that may be relevant.

    Contravention report

    May record the situation, participants, relevant circumstances, rule breached and sanction. Its whole content matters, not merely the fine.

    The document commonly called “Annex no. 2”

    May communicate accident data to the insurer, but is not necessarily required or available in identical form in every file.

    Repair authorisation

    Relevant to property damage and permits repair under stated conditions. It does not alone determine fault, value or bodily injury.

    Proof of registration or investigation

    While a file is pending, a record may confirm the event, competent unit and case or work number.

    The Road Police may provide copies to insurers on request. Individual access may depend on status and stage of investigation.

BAAR lists examples such as the contravention report, Annex no. 2, amicable statement or judgment, and repair authorisation. The actual list depends on the recipient and claim.

04 / Pending file

While investigations continue.

A pending investigation does not necessarily prevent notification or opening of the claim. Available documents can be registered, although final settlement may await clarification of liability, criminal-file records or further proof of loss.

Practical approach
  • notify the insurer without waiting passively for the investigation to finish;
  • file available documents and obtain a registration number;
  • ask in writing what is missing and why;
  • add relevant new documents when issued.

05 / Written information

What the RCA insurer must communicate.

On notification, the insurer opens a file and informs the injured party in writing of the documents required. Filed documents must be registered. A general request for “all police papers” should be clarified by asking for the document name, purpose and whether the insurer can obtain it directly.

  • retain copies and proof of transmission;
  • obtain registration of every document;
  • answer requests for additions in an organised way;
  • separate accident evidence from proof of loss.

Important clarifications.

Is Romanian ‘Annex no. 2’ compulsory in every RCA claim?+

No. Required documents depend on the accident and how it was recorded. Names and availability of police documents may vary; the insurer must state in writing what is needed.

Is the amicable accident statement issued by the Road Police?+

No. It is completed by the drivers and may be used only under the statutory conditions for accidents involving property damage. It does not replace duties applicable where a person is injured or killed.

Can a claim be opened before a criminal investigation ends?+

The event can be notified to the insurer, although later settlement may require further documents about circumstances, liability or the judicial outcome.

Can the insurer obtain documents directly from the Road Police?+

Romanian road legislation allows accident documents to be sent to insurers upon request. Ask the insurer which records it will obtain directly and which the injured person must provide.

Does the repair authorisation prove fault?+

No. It permits repairs under its stated conditions, but does not by itself determine liability or prove the extent of bodily injury.

Are police documents sufficient for bodily injury compensation?+

No. They document the event. Injury, treatment, progress and consequences require medical and, where appropriate, medico-legal evidence.
